Pennsylvania State Law Section 603

Regarding the selling, bartering or trading dogs:

(a) Illegal Transfers- It is unlawful to offer a dog as an inducement to purchase a product, commodity or service.

(b) Illegal to Transfer Ownership of Certain Puppies- It is unlawful to barter, sell, auction or in any way transfer ownership of a dog under 7 weeks of age, unless the dog has been orphaned and it becomes necessary to transfer the pet to a nonprofit kennel, shelter or veterinarian.

(c) Illegal for Certain Persons to Transfer Dogs-  It is unlawful for any person to buy, sell, transfer, barter, trade, raffle, auction or rent a dog at any public place in this Commonwealth other than a kennel licensed pursuant to this act, or a dog show or field trial sponsored by a recognized breed association.The only people who can trade, sell or transfer a dog on the premises of a kennel are employees who represent the kennel.

Don’t risk a fine, if you have puppies to give away, you are in violation of Pa. law if you give, trade or sell them on public property and you don’t have a state issued Kennel License.

It is better to release your animals to a shelter or rescue group because then they will get the necessary vaccines and will be spayed and neutered upon adoption. Giving or Selling dogs without  proper screening, landlord and home checks of the new adoptees is not advisable. Pets need responsible, permanent homes with individuals who can provide comfortable, safe housing for animals, quality food and veterinary care. Pets incur expenses!
